General conditions
1. Purpose and operator of the activity
These general terms and conditions govern the provision of the accommodation service to guests who book their stay at www.rentalscollection.com, the website of The Rentals Collection, S.L., tax ID (CIF) B75077578, with registered office at Easo Kalea 15, B, 20006 Donostia / San Sebastián (Gipuzkoa).
The Rentals Collection, S.L. is the operator of the accommodation activity and provides the service in its own name, with its own resources and staff. It operates, as a single operating unit, a number of tourist-use dwellings (viviendas de uso turístico) and tourist apartments in Donostia / San Sebastián, registered in the Basque Country Register of Tourism Companies and Activities.
Each accommodation unit is a classified economic activity and holds the planning authorisation for tertiary accommodation use.
The rate covers accommodation by the day and the services included in every stay: a reception desk open to the public from Monday to Sunday at San Martín Kalea 37, B, 20005, Donostia / San Sebastián, 24-hour telephone assistance from our own team, periodic cleaning with a change of bed and bath linen, maintenance, luggage storage and concierge service.
2. Booking, rate and payment
The booking is confirmed once the amount of the stay has been paid and The Rentals Collection has sent its electronic confirmation. With the confirmation, the guest receives the booking details, these terms and conditions and the arrival instructions.
Rates include VAT. The tourist stay tax is charged separately, as set out in section 11.
The guest declares that they have read and accepted these general terms and conditions before making the payment.
3. Cancellation
The guest may cancel the booking at any time. The amount of the stay that is refunded depends on the notice given:
- Up to 31 days before the arrival date: 90% refund.
- Between 30 and 8 days before the arrival date: 50% refund.
- From 7 days before the arrival date, or in the event of a no-show: the booking is payable in full.
An early departure, once the stay has begun, leaves the amount of the booking payable in full.
As this is an accommodation service for specific dates, the booking is governed by this cancellation policy and is excluded from the right of withdrawal.
4. Change of accommodation
Where, for unforeseen reasons beyond the company's control, the accommodation booked cannot be occupied, The Rentals Collection will offer the guest another of the same or a higher category, at no additional cost.
The guest may accept the accommodation offered or opt for a full refund of the amount paid.
5. Arrival, registration and occupancy
Check-in is from 3:00 pm and check-out is before 11:00 am. Check-in takes place at the reception desk or by the means indicated in the arrival instructions.
All guests identify themselves on arrival, in accordance with the guest registration rules that apply to accommodation activities.
The listing for each accommodation states its maximum capacity, which includes adults and children of any age. The accommodation is reserved for the persons registered in the booking. Any change in the number of guests must be notified to The Rentals Collection and requires its express authorisation.
6. Use of the accommodation and consideration for neighbours
The accommodation is used exclusively to lodge the registered persons, which is the authorised use of each unit. The guest uses it with due care and looks after its facilities, furniture and equipment.
Our accommodation is located in buildings that we share with our neighbours, whose rest we protect. Quiet hours run from 9:00 pm to 9:00 am.
The following, among others, fall outside the accommodation use:
- holding parties, gatherings or events;
- access or stay by persons not included in the booking without the express authorisation of The Rentals Collection;
- carrying on any professional or commercial activity in the accommodation, including receiving clients or members of the public, as well as recordings or sessions for commercial purposes;
- and, in general, any activity that is unlawful, contrary to public order or unrelated to the lodging of the registered persons.
The guest is liable for damage caused to the accommodation, its furniture or its equipment through misuse or negligence, and for the loss of keys.
7. Early termination of the stay
The Rentals Collection may bring the stay to an end and require the guest to leave the accommodation immediately in the following cases:
- use of the accommodation for purposes other than lodging, as set out in section 6;
- conduct that seriously disturbs the peace or rest of other guests or of the neighbours;
- intentional or negligent damage to the accommodation, its furniture or its equipment;
- repeated breach of the house rules communicated by the company.
In these cases the stay ends with the amount of the booking payable in full, and the guest is also liable for any loss or damage caused.
8. Liability of the company
The Rentals Collection is responsible for the provision of the accommodation service under these terms and conditions and the law.
Building works in the building, in adjoining buildings or in the street, the actions of third parties, interruptions to public utilities, force majeure events and, in general, any circumstance beyond its organisation and control fall outside the scope of liability of The Rentals Collection. These circumstances do not alter the terms of the booking. Where the company has advance knowledge of any such circumstance that may affect the stay, it will inform the guest.
9. Data protection
The Rentals Collection, S.L. is the controller of the personal data provided in the booking and at check-in, in accordance with Regulation (EU) 2016/679 and Spanish Organic Law 3/2018.
The data are processed to manage the booking, the stay and the commercial relationship (provision of the accommodation service) and to comply with the guest registration and reporting obligations to the competent authorities that the law imposes on accommodation activities (legal obligation). They are kept for the periods that those rules establish.
The guest may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability at info@rentalscollection.com, and may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos). Full information is available in the privacy policy of this website.
10. Legal framework and jurisdiction
The provision of the accommodation service is governed by these general terms and conditions, by the tourism legislation of the Basque Country, by the Civil Code and by consumer protection legislation.
Complaint forms are available to guests at the reception desk.
Any dispute will be submitted to the Courts of Donostia / San Sebastián, the place where the service is provided, without prejudice to the jurisdiction that the law grants to consumers.
11. Tourist stay tax
From 1 January 2027, the Gipuzkoa tourist stay tax will apply in Donostia / San Sebastián.
The tax applies to adult guests, per person and per night, up to a maximum of 6 nights per stay.
Its amount, with the applicable VAT, is added to the price of the stay and shown separately.
The amount will be set in the municipal tax by-law, which is pending final approval. We will inform our guests as soon as it is approved.
12. Monthly rental
The properties identified in their listing as "Monthly rental" are offered under a seasonal lease (arrendamiento de temporada), for stays of months that respond to a temporary need of the client.
Each seasonal lease is governed by its own contract, which the parties sign before arrival and which sets out the term, the reason for the temporary nature of the lease, the rent, the deposit and the other conditions, and by Spanish urban leases legislation.
The preceding sections govern the accommodation service. Only the rules on use and consideration for neighbours in section 6 and section 9, on data protection, apply to seasonal leases.
