1. Rental policies and general terms
These general terms and conditions govern reservations made through the website www.rentalscollection.com, owned by The Rentals Collection, S.L., with tax identification number B75077578 and registered address at C/ Easo 15, Bajo, 20006 Donostia / San Sebastián (Gipuzkoa).

The company carries out a professional hospitality activity in accommodations classified as tourist apartments and dwellings for tourist use, in accordance with the tourism, urban planning and sectoral regulations in force in the Basque Autonomous Community.

The tourist apartments and dwellings for tourist use operated by The Rentals Collection, S.L. in San Sebastián are not dwellings and do not operate on residential land, but are legally framed within the hospitality sector, operating on tertiary-use land. Therefore, the units managed by The Rentals Collection, S.L. do not constitute, in a legal or urban-planning sense, dwellings, but classified economic hospitality activities subject to the administrative frameworks applicable to hotels and similar establishments.

2. Reservation and Payment
A reservation will be considered confirmed once full payment has been made and electronic confirmation has been received from The Rentals Collection. The client declares having read and accepted these general terms and conditions prior to payment.

3. Cancellations by the Client
The client may cancel the reservation at any time, with partial reimbursement according to the following schedule:
- Up to 30 days before arrival: 90% refund.
- Between 29 and 7 days before arrival: 50% refund.
- Less than 7 days before arrival: no refund.
No reimbursement shall be made if the client voluntarily withdraws before completing the stay.

4. Modifications by the Company
If, due to unforeseen circumstances beyond the company’s control, the reserved accommodation cannot be occupied, The Rentals Collection will provide the client with alternative accommodation of equal or superior category, with no additional refund or compensation due from either party.

5. Use of Accommodation and Client Responsibility
The client agrees to use the accommodation diligently and solely for hospitality purposes, respecting the rules of coexistence, neighbourhood rest hours and proper use of the facilities. The client will be liable for any damage caused by negligence or misuse of the accommodation, furniture or equipment, as well as for the loss of keys or damages arising from their actions.

6. Company Liability
The Rentals Collection shall not be held liable for personal belongings left in the accommodation, nor for incidents arising from force majeure, public service interruptions or actions of third parties unrelated to the company.

7. Occupancy, Conduct and Use Conditions
Each accommodation’s data sheet indicates the maximum permitted capacity, counting both adults and minors regardless of age. The accommodation may not be occupied by more people than those specified in the reservation. Any modification in the number of occupants must be expressly communicated and authorised by the company.

The accommodation must be used solely for temporary hospitality purposes, and any other use is strictly prohibited, including but not limited to:
- hosting parties or unauthorised gatherings,
- allowing access or stay of unregistered persons without express authorisation from The Rentals Collection,
- organising events or recordings for commercial purposes,
- and, in general, carrying out illegal activities or actions contrary to morality, good customs or public order.

The client must also respect the quiet hours between 21:00 and 09:00, avoiding any noise or behaviour that may disturb coexistence.

Failure to comply with any of these conditions entitles The Rentals Collection to immediately terminate the contract, demand evacuation of the accommodation, and retain any amounts paid as a penalty, without prejudice to any legal action or compensation that may apply.

8. Early Termination and Expulsion
The Rentals Collection may immediately terminate the hospitality contract and require the client to vacate the accommodation if any of the following occur:
- Use of the accommodation for purposes other than hospitality, including illegal or immoral activities.
- Behaviour that seriously disturbs other clients or neighbours.
- Intentional or negligent damage to the accommodation, furniture or equipment.
- Repeated breach of internal rules of stay communicated by the company.
In such cases, the client shall forfeit any right to reimbursement and must vacate the accommodation immediately, without prejudice to any legal action or compensation that may follow.

9. Data Protection
In compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Data Protection and Digital Rights, the data provided during the booking process will be processed by The Rentals Collection, S.L. for the purpose of managing reservations, stays and client relations. Clients may exercise their rights of access, rectification, erasure, opposition, restriction and portability by writing to info@rentalscollection.com.

10. Applicable Law and Jurisdiction
These conditions are governed by Spanish law, and specifically by the rules relating to hospitality services and consumer protection, with the express exclusion not only of the Spanish Urban Leases Act (LAU) but also of any regulation or provision related to residential or housing uses.
The tourist apartments and dwellings for tourist use managed by The Rentals Collection, S.L. are not dwellings in a legal or urban-planning sense, but classified economic hospitality activities developed on tertiary-use land.
Any dispute shall be submitted to the Courts and Tribunals of Donostia / San Sebastián (Gipuzkoa), with express waiver of any other jurisdiction.

11. Tourist tax

The Basque Administration is preparing to introduce a tourist tax; however, no official effective date has been established yet.

Once in force, the tax will be added to the total cost of the stay in accordance with the applicable regulations. When that time comes, we will inform all guests in advance, ensuring clarity and preventing any impact on existing reservations.
